The Research Unit on Authorship and Rights (URAD), established at the DISTU, aims to continue and develop studies and research on copyright and the arts initiated during the Department of Linguistic-Literary, Historical-Philosophical, and Juridical Studies (DISTU) Excellence Project (2018 – 2022) at the University of Tuscia.
Within the section on law and art (ADiA) of the Academy of Law and Multicultural Societies, established in the Project with the aim of investigating the crises of its cultural and institutional space, there arose the need to create a study group on open issues surrounding copyright. Within it, the presence of jurists, art historians, dance scholars, archivists, historians, and restorers is based on the preliminary belief in the potential effectiveness of a dialogue with the “living matter” – authors, industry operators, scholars – that constitutes the horizon of copyright.
The preliminary consideration of the multiple meanings to refer to when dealing with the copyright galaxy – author copyright, reproduction copyright, the rights holders’ chain, as well as the new European directive on the subject, and the uncertain boundaries of authorship – has led to a confrontation on the issue through diverse disciplinary experiences and competencies with the aim of deepening the understanding of some aspects that significantly impact the experience of the arts and their transmission in our era.
In addition to seminars and publications, among the initiatives undertaken by the copyright research group was the creation of a database to establish an open and continuously growing archive. The “Copyright Case Studies” database collects examples of copyright through several reference categories that, while not exhaustive, prioritize issues related to artistic culture in a broad sense. Conceived as a catalog, in this database, each case of dispute refers to the respective jurisprudential decisions.
In the broad multidisciplinary framework of the study group, whose members are researchers and scholars both internal and external to the University, the following activities have been carried out:
